1. Statement/Scope
www.natur-im-garten.at is an online-offer of “die umweltberatung”, union of Austrian environment information offices and the environment protection club “Citizen & environment”, “die umweltberatung” LA, Bad Erlach. In addition to the editorial content the user can e.g. offer plants in the exchange market, insert want ads as well as chat with other users in the forum.
For using the following provisions are binding.
2. Concession of rights
By loading the texts the user of www.natur-im-garten.at allow the right free of charge, to save, make available to the public and offer for downloading of all materials, unlimited in period and location, as well as to use in online- and print-media for advertisings. Within the ads, all loaded texts may also be editorially accentuated and assessed. All contents may looked at and read by other users, transferred to the own PC and saved for personal purposes. However, every – especially for commercial purposes – realization of the contents is subject to permission by the authors.
The user is solely responsible to become entitled by www.natur-im-garten.at for loading of photos/videos/texts and for respective use of them. As a rule, the users own the right only when the photos/videos/texts are produced by themselves or they have acquired third-party rights, when the contents do not originate from themselves, and if the imaged person has given the affirmation. In addition, the right of imaged objects (e.g. work of art) may be a property of third party and permission by authors is necessary. It is in the responsibility of the user to sort out exceptions in those necessities of acquiescence.
The operators of www.natur-im-garten.at have the right to delete themes and contributions, to edit, to relocate or to close.
3. Undue contents
Contents – available for other users of www.natur-im-garten.at – must not offend common decency or legal restraints or infringe third-party rights (copyright and related rights as to name, label, data privacy etc.).
In particular, it is interdicted to propagate contents with direct or indirect pornographic ideas, glorifying violence or incitement of the people, to call up or instruct for criminal acts and to infringe other person’s political and religious opinions.
Moreover, no contents must be propagated via www.natur-im-garten.at, which contain or display viruses or spasm, and/or pursue a commercial or other trade purpose.
However, www.natur-im-garten.at has no technical possibilities to detect or cut off misuse; this is alone a matter of the users.
4. Consequences of violations
In case of violating these terms of use, the operator of international.natur-im-garten.at reserves the right to eliminate or change those contents. The respective user is excluded temporarily or enduringly.
The user dispenses international.natur-im-garten.at from third-party’s justified claims, alleged to www.natur-im-garten.at , its legal representatives and/or performing agents on the base of paragraph 2 and/or 3.
5. Data privacy
www.natur-im-garten.at ensures the compliance with legal data privacy. Personal data, e.g. e-mail-address, photos of users are only propagated by www.natur-im-garten.at with explicit acceptance only. Please, mind our detailed privacy policy, too.
6. Continuation of our offers
www.natur-im-garten.at may decide at any time to abandon all or part of the services, to conduct subject to a charge or to modify. By no means, the user has a right for compensation because of deletion of a text downloaded by him/her. The user is indebted to save the data by him/herself.
